Srinagar: A fresh complaint has been moved by a Supreme Court advocate to seek preliminary enquiry and subsequent lodging of case against Jammu and Kashmir National Conference Srinagar Parliamentary seat nominee Aga Syed Ruhullah Mehdi for tendering of ‘false information in election affidavit.’

The Complainant has in his complaint maintained that, “Mr. Syed Ruhullah Mehdi, a National Conference, candidate contesting in Lok Sabha Elections -2024, from Parliamentary Constituency – 02 (Central – J&K ), has intentionally provided information known by him to be false and untrue in his election affidavit, while submitting his nomination papers before the office of Returning Office, Parliamentary Constituency – 02, Srinagar, Budgam, Pulwama and Shopian (parts of the District).

“It is submitted that this is a cognizable offence under various sections of the IPC and calls for his disqualification as per Representation of Peoples Act. Such omission and commission is a grave attempt to mislead the people and the authorities despite a legal oath and pledge in the said affidavit to provide true information. Besides, this is unbecoming of a candidate to represent the citizens in the Lok Sabha.”

“In light of recent information provided under R.T.I. Act (a copy of reply to RTI, is attached herewith), it has come to fore that Mr. Syed Ruhullah was in fact born in 1982 as against 1977, that he has wrongly stated in his election affidavit,” reads the complaint.

“It is also pertinent to mention that, as per information his parents were duly married in 1981 and his claim of being born allegedly in year 1977-78, four years before the marriage of his parents, evidences the fact of the fabrication of the date of birth. Which date of birth that he has provided even during 2002 Assembly Elections, to contest his first election though in fact being an unqualified and underage candidate.”

“There are also reports that the said individual’s year of birth in his passport is different from the one which he has provided in his election affidavit, besides his records mentioned and recorded in the Aligarh Muslim University, Aligarh attended by him from Grade 11th in 1999-2000, shortly before contesting election as an underage candidate,” reads the complaint.

“This is a gross violation of law and amounts to fraud, criminal conspiracy and perjury and aims to discredit the impartiality and institutional sanctity of various institutions of our democratic setup. In this regard, a complaint has been also filed with the office of the Deputy Commissioner, Srinagar — RO. However, the RO has not taken the matter seriously and redirected the undersigned to move to court or else your good office,” the complaint maintains.

“You are kindly requested to direct the local concerned police authorities (Superintendent of Police, South Srinagar) to conduct an impartial inquiry into the matter and for that matter an FIR under relevant sections of the law be lodged to uphold the truth and confidence of the general public in the administration of law and justice. The undersigned has reasonable apprehension that there may be tempering of the records, therefore, beseech your good self, to kindly summon the records of Birth and Death (Register) from the Srinagar Municipal Committee, Concerned Hospital (Kashmir Nursing Home Gupkar), Passport office, Srinagar, and Aligarh Muslim University. Such records may kindly be summoned in sealed cover, ruling out any possibility of tampering,” the complaint further reads.
