Er Rashid Interim Bail Plea: Delhi HC Lists Next Hearing To Feb 4

Srinagar: Delhi High Court on Thursday listed next hearing in bail plea of Member Parliament Er Rashid to February 4.

Rashid’s counsel has been seeking a reprieve on the ground to allow his client attend the upcoming budget session of the Parliament, which begins on January 31 and concludes on April 4.

The instant plea forms part of MP’s pending petition on the issue of granting him bail in the case by the NIA.

Er. Rashid’s counsel argued that the application for bail has been pending for five months before the trial court.

Contending that an interim bail can be given to Er Rashid, the counsel said that his client was granted interim bail earlier and there was no instance of any misuse by his client (Er Rashid).

“When it suits them, he can get interim bail for campaigning. When it does not suit them, he cannot (get interim bail),” the counsel remarked.

Underlining that he (Er Rashid) has received official orders to join the upcoming budget session, the counsel said that his client hasn’t been let to represent in last two parliamentary sessions.

After hearing to the arguments, the Court listed the case to February 4, 2025, at 3:30 PM.

In the meantime the MP in his main petition, has urged the High Court to either direct the expeditious disposal of his pending bail application by a lower court here or decide the main plea itself.

Rashid was elected from the Baramulla constituency in the 2024 Lok Sabha elections and has been lodged in Tihar Jail since 2019 after the NIA arrested him under the Unlawful Activities (Prevention) Act in the 2017 militant-funding case. The ED filed a money laundering case against the accused persons on the basis of the NIA’s FIR, which accused them of “conspiring to wage war against the government” and “fomenting trouble” in the Kashmir valley.
