Srinagar: District Consumer Dispute Redressal Commission, (Consumer Court), Kupwara on Thursday delivered two consequential judgments, settling two weighty insurance claims. The double judge bench, led by Pirzada Qousar Hussain with Nyla Yaseen as member, known for their proactive stance, while ruling in favour of the litigants directed the respondents to compensate the aggrieved parts in a time-bound manner.
Abdul Sattar, an aggrieved shopkeeper from Lolab, had approached the Court regarding the non-settlement of his insurance policy, after his shop got damaged during floods in his native area in 2010. Even as making all the evidence and proofs available before the Insurance Company, the aggrieved person was denied his due compensation. Made to run from pillar to post, the particular case was in 2024 transferred to the District Consumer Court Kupwara. Assessing the merits of the case, the double judge bench, Pirzada Qousar Ahmad and Nyla Yaseen, disposed of the matter within a span of few months, much to the relief of litigant.
The double judge bench, as per Alfaaz – The Words, ordered the respondents to compensate the aggrieved party with an amount of nine lac seventy seven thousand rupees, which the former party duly accepted and handed over a cheque in the open court.
In another case, which saw final settlement today only, involved one Showkat Ahmad. The litigant in the particular case had claimed before the Court about denial of insurance benefits from the insurer. The Court after looking into the nitty gritty of the case, lying before it since 2018, disposed of the matter, directing the Insurance Company to disburse an amount, as compensation to the litigant, in tune of eleven lac rupees.
The two significant judgments have set a strong precedent vis-a-vis the disposal of Consumer complaints amid a steep rise in the unscrupulous practices resorted by sellers of different policies and products.
With regard to Consumer Court Kupwara, the President Pirzada Qousar Hussain and Nyla Yaseen have been too proactive with their roles and have already settled multiple high-profile claims in the frontier north Kashmir district.
