Baramulla: Hon’ble District Consumer Disputes Redressal Commission (DCDRC) Baramulla has ruled in favor of a mobile-phone buyer, a student then, and directed the mobile shop owner to pay a fine in tune of rupees thirty-thousand towards the aggrieved customer in stipulated time period.

As per the details of the case available, one Irshad Ahmad Sheikh, filed complaint dating back to 2015 under Section 12 of the Consumer Protection Act, 1986 against Sopore Electronics, Main Chowk Sopore, after buyer’s mobile-phone – Samsung Galaxy 7262 mobile phone with a cash memo dated 07/07/2014, for rupees 5,900 – malfunctioned within few days.

The complainant then approached Samsung Galaxy Center in Baramulla on 20/07/2014, but the phone remained unrepaired instead the service centre, as per the complainant, formatted the memory card. Subsequent, the Complainant moved to the service center on 25/07/2014, however it again yielded no relief, much to the buyer’s anguish.

Stating that the issue disrupted his academic pursuits as a student at Kashmir University, it at the same time rendered him unable to afford a replacement.

The Consumer Commission found the opposite parties, in this case, guilty of unfair trade practices, specifically selling a defective phone and failing to rectify the issue. The Court subsequently adjudicated the opposite parties to replace the phone and provide the aggrieved customer Irshad Ahmad Sheikh with Rupees 30,000 as compensation within thirty days. “Failure to comply will result in an annual interest rate of 9% applied to the compensation amount until it is paid.”

This ruling sets a criterion in favor of consumers, emphasizing the importance of accountability and fairness in the sale and servicing of consumer electronics’. It underscores the significance of the Consumer Protection Act in safeguarding the rights and interests of consumers, ensuring they receive the quality products and services they rightfully expect.

Pertinent to mention that the court ordered the accused be arrested by the Police Station Sopore and Baramulla and be produced before the Hon’ble court on 3 Oct 2023 to make them pay a fine of rupees 30000 to the complainant in compliance with the orders passed in the case.
